Obama Water Rule Replacement Ends Lawsuit by Ohio, Tennessee

Ohio and Tennessee can’t sue to block an Obama-era water rule that’s inactive and that agencies have replace at least twice, an Ohio federal court ruled.

The states sued after the federal government issued a rule in 2015 that redefined which waters qualify for federal protections under the Clean Water Act. The Trump administration formally repealed the Waters of the United States rule, also known as WOTUS, and replaced it in June 2020.
