No Immunity for Cop Who Shot Unarmed Suspect in Back

A deputy who shot and killed an unarmed, non-dangerous suspect in the back isn’t entitled to qualified immunity in the civil rights suit against him, the U.S. Court of Appeals for the Ninth Circuit ruled Oct. 10 (Longoria v. Pinal County, 2017 BL 363140, 9th Cir., No. 16-15606, 10/10/17).

There were questions whether the deputy acted reasonably, given the totality of the circumstances and the law at the time of the incident, the court’s opinion by Judge Stephen Reinhardt said.
