Apple Sees Discovery Suit Revived in Biometric Security Dispute

A discovery suit against Apple Inc. by a foreign company seeking documents to use in a German case involving biometric security patents was revived by the Ninth Circuit.

A magistrate judge in the US. District Court for the Northern District of California said CPC Patent Technologies PTY Ltd.'s suit should be dismissed because the request was unduly burdensome and CPC could have access to the documents it sought through another federal case it had pending against Apple. The district court declined to overturn the magistrate judge.
