Army Corps Seeks Redo of Disputed Louisiana Wetlands Finding

The US Army Corps of Engineers wants to reconsider whether a property in Louisiana contains environmentally protected waters, telling a federal judge in the state that recent developments rendered its original decision “functionally irrelevant.”

Garry Lewis and Garry Lewis-Louisiana LLC sued after the Corps said the 2,000-acre property in Livingston Parish contained “waters of the US” and was therefore subject to regulation under the Clean Water Act. The agency applied the 2020 Navigable Water Protection Rule that defined WOTUS. But two courts tossed the NWPR in 2021, and the agency says it stopped implementing the rule nationwide.
