Safety Judicial Panel Upholds Policy on Multi-employer Citations

A federal review panel has upheld OSHA’s ability to cite construction companies even when their employees weren’t endangered in certain situations.

But the Occupational Safety and Health Review Commission in the same decision said evidence didn’t support the citation against the construction company that sparked the legal challenge.

The decision released Wednesday backs the Occupational Safety and Health Administration’s longstanding multi-employer policy for citing general contractors for violations that originated with subcontractors if the general contractors didn’t take adequate protective measures.
