Treasury is asking the U.S. Court of Appeals for the Eleventh Circuit to overturn a permanent injunction on its enforcement of the American Rescue Plan Act’s offset provision, which the trial court called “an unconstitutionally ambiguous condition on the States’ receipt of federal funds.”
